A Birmingham man has been accused of throwing a dog over a balcony. Sean Patrick attended Birmingham Magistrates’ Court on Thursday, January 16, after being prosecuted by the RSPCA.
The 31-year-old, from Northfield, is charged with causing suffering to a protected animal, a bull type dog, on July 22 last year. Prosecutor Janita Patel summarised the case and alleged Patrick threw his dog named ‘Blue’ over a balcony at his previous flat, causing it to fall 3.7metres (12.1 feet) to the ground.
She told the court a witness recovered the dog and took it to a vet. Patrick pleaded not guilty to the charge.

HIs solicitor Alexander Moyler told the court the issue in the case was a ‘factual denial’. He said Patrick’s account was that Blue was a puppy at the time and regularly tried to squeeze through the railings of the balcony which he managed to do in the incident in question.
The case was listed for a summary trial at Birmingham Magistrates’ Court on June 13. Patrick was granted unconditional bail.
